Is ADP Taxable? Adult Disability Payment, Tax, Income and Means Tests

Updated October 2026 · 11 min read · By ADPexpert

Is ADP taxable? No. Adult Disability Payment is tax-free. UK tax law lists it among the social security benefits on which no liability to income tax arises, and GOV.UK names it on its list of tax-free state benefits. ADP is not means tested either. mygov.scot puts it plainly: it does not matter if you are working or not, and your income and savings are not taken into account. So whether your award is £30.30 a week or the full £194.60, which comes to more than £10,000 a year, you keep all of it, it never uses up any of your Personal Allowance and it does not need to go on a tax return.

Is ADP taxable? What the law says

Income tax on benefits is decided by UK law, even for a Scottish benefit. Section 677 of the Income Tax (Earnings and Pensions) Act 2003 contains Table B, a list of social security benefits that are wholly exempt from tax, and says that no liability to income tax arises on anything in it. Adult Disability Payment was added to Table B in 2022, the year ADP opened across Scotland, by statutory instrument 2022/529.

It sits there with several other payments made under the Social Security (Scotland) Act 2018, so the same answer covers the payments people move between:

GOV.UK's own list of tax-free state benefits names "Adult Disability Payment (ADP) in Scotland" next to Personal Independence Payment, Attendance Allowance and Disability Living Allowance. In other words, ADP gets the same tax treatment PIP gets in the rest of the UK, so moving between the two systems does not change your tax position.

Do you need to declare ADP on a tax return?

No. If you fill in a Self Assessment return, perhaps because you are self-employed or let out a property, leave ADP off it. HMRC's notes for the 2026 return say "Not all benefits are taxable" and tell you not to include Personal Independence Payment or Attendance Allowance in the boxes for pensions and state benefits. ADP is not named in that short list, but the notes send you to GOV.UK for what is and is not taxable, and GOV.UK lists ADP as tax-free. The benefits that do belong on the return are taxable ones such as the State Pension, contribution-based Employment and Support Allowance and Jobseeker's Allowance.

ADP also has no part in your tax code. The standard Personal Allowance for 2026 to 2027 is £12,570, and it is measured against your taxable income only. Scotland has its own income tax bands, which change how much tax you pay on wages or a pension, but they never reach ADP because there is no tax to charge on it.

Example. Moira was getting ADP before she reached State Pension age, so she stays on ADP rather than moving to Pension Age Disability Payment. Her State Pension is taxable and counts towards her £12,570 Personal Allowance. Her ADP does not count at all, so it cannot push her into paying tax, however large her award.

Is ADP means tested?

No. ADP is based on how a disability or long-term health condition affects your everyday life, not on your money. Social Security Scotland scores 12 activities, 10 for daily living and 2 for mobility. 8 to 11 points on a component gives the standard rate and 12 or more the enhanced rate, as our guide to the ADP points system explains. Nothing in that test looks at your bank balance.

What does matter is any change in how your condition affects you. mygov.scot asks you to contact Social Security Scotland if your circumstances change, and our guide to ADP change of circumstances sets out what to report and how a change can raise an award as well as lower it.

Does ADP count as income for other benefits?

Because ADP is not means tested, the next question is whether it cuts the means-tested help you get. In each of the main schemes it is ignored as income, and in several it can increase what you receive.

BenefitIs ADP counted as income? Can ADP help?
Universal CreditNoYes: an ADP award lifts the benefit cap
Pension CreditNoIt can: you might qualify on a higher income
Housing BenefitNoYes: ADP qualifies for the disability premium
Council Tax ReductionNoYes: ADP qualifies for the disability premium

Universal Credit

Regulation 66 of the Universal Credit Regulations 2013 lists the unearned income that reduces Universal Credit. Carer's Allowance, Carer Support Payment, contribution-based ESA and Jobseeker's Allowance are on it. ADP, PIP and Disability Living Allowance are not, so you can get your full ADP and your full Universal Credit at the same time.

ADP also takes your household out of the benefit cap. GOV.UK lists Adult Disability Payment among the benefits that mean you are not affected, and regulation 83 of the same regulations applies the exemption where you, or a young person you are responsible for, are receiving ADP. It names no component, so an award of the mobility component alone counts as well. Our guide to ADP and Universal Credit covers the carer element and reporting the award.

Pension Credit

GOV.UK's Pension Credit guidance lists Adult Disability Payment, Pension Age Disability Payment and Personal Independence Payment among the benefits that are not counted as income. It also says you might still be eligible for Pension Credit with a higher income if you have a disability. This matters because ADP can continue past State Pension age: mygov.scot confirms that if you already get ADP, you stay on it when you reach that age. Pension Age Disability Payment, for people who first claim later, is not means tested either.

Housing Benefit

Schedule 5 to the Housing Benefit Regulations 2006 lists the income that is disregarded. Paragraph 73 covers any disability assistance given under section 31 of the Social Security (Scotland) Act 2018, which is the power ADP is made under, and paragraph 72 covers Short-term Assistance. Schedule 3 then works in your favour: ADP is one of the qualifying benefits for the disability premium, and the daily living component at either rate is one of the conditions for the severe disability premium. Our guide to ADP and Housing Benefit explains the premiums and the Scottish help with the bedroom tax.

Council Tax Reduction

In the Council Tax Reduction (Scotland) Regulations 2021, regulation 57 sets out the benefits treated as unearned income, and ADP is not among them. Schedule 1 goes further: getting adult disability payment is one of the ways to meet the condition for the disability premium, which raises the amount you are allowed to have before your reduction is cut. An ADP award can therefore increase your Council Tax Reduction, so tell your council when it starts.

The exception: payments your carer gets

If someone looks after you for at least 35 hours a week, your ADP daily living award can open the door to Carer Support Payment for them. That payment is treated differently from yours. GOV.UK lists Carer Support Payment as taxable, and Universal Credit counts it as unearned income up to the amount Carer's Allowance would pay. It is worth knowing before a household budgets around it. See ADP and Carer Support Payment for who qualifies.

Are ADP back payments taxable?

No. A back payment is still Adult Disability Payment, so it is tax-free in the same way, however many weeks it covers. ADP awards often start with arrears because entitlement is backdated, and a successful re-determination or appeal can bring a larger lump sum. Our guide to ADP back payments explains how they are worked out.

The one thing to watch is savings if you are on Universal Credit. A lump sum sitting in your account can look like capital, but Schedule 10, paragraph 18 of the Universal Credit Regulations ignores arrears of any social security benefit that is not counted as unearned income, which covers ADP, for 12 months from when you receive them. After that, anything left is treated as savings in the usual way. GOV.UK explains that savings over £6,000 reduce Universal Credit by £4.35 for every £250, and that you need £16,000 or less to qualify at all.

Tip. Keep the letter from Social Security Scotland that explains a back payment. If Universal Credit asks about a large deposit, it shows the money is ADP arrears and when you received it.

Is Short-term Assistance taxable?

If an existing award is reduced or stopped and you challenge it, Short-term Assistance can make up the difference while the re-determination and any appeal run. It is tax-free under the same Table B, it is disregarded for Housing Benefit and it is not on the Universal Credit list of unearned income. mygov.scot says you will not need to pay back Short-term Assistance you are entitled to, whatever the outcome of your challenge, unless the original award was applied for fraudulently. Only an amount paid in error that you caused or could reasonably have noticed can be recovered. Our guide to Short-term Assistance covers how to ask for it.

Putting it into practice

The amount you keep depends on your points

Since nothing is taken off for tax or income, the only thing that decides your ADP is the points you are awarded. For 2026 to 2027 the weekly rates are:

ComponentStandard rate (8 to 11 points)Enhanced rate (12+ points)
Daily living£76.70£114.60
Mobility£30.30£80.00

Enhanced on both components is £194.60 a week, tax-free and with no means test. Our guide to ADP rates for 2026/27 walks through every combination. Points come from what you write on the ADP application Part 2 and the supporting information behind it, which is why what to write on Part 2 is worth reading before you start.

Frequently Asked Questions

Is Adult Disability Payment taxable?

No. Section 677 of the Income Tax (Earnings and Pensions) Act 2003 lists Adult Disability Payment among the benefits on which no income tax arises, and GOV.UK names it as a tax-free state benefit. Both components are tax-free at either rate, and so is Short-term Assistance.

Is ADP means tested?

No. mygov.scot says it does not matter if you are working or not, and your income and savings are not taken into account. ADP depends only on the points you score across the 12 daily living and mobility activities.

Do I need to declare ADP on my tax return?

No. HMRC's notes for the 2026 Self Assessment return say not all benefits are taxable and point you to GOV.UK, which lists ADP as tax-free. Only taxable benefits, such as the State Pension, go on the return.

Does ADP count as income for Universal Credit?

No. ADP is not on the list of unearned income in regulation 66 of the Universal Credit Regulations 2013, so it does not reduce Universal Credit. Receiving ADP, either component, also exempts your household from the benefit cap.

Can I work and still get ADP?

Yes. Your earnings and savings are not taken into account, so you can get ADP whether you work full time, part time or for yourself. Tell Social Security Scotland if your circumstances change, such as how your condition affects you.

Are ADP back payments taxable?

No. A back payment is still ADP and is tax-free. If you get Universal Credit, arrears of ADP are ignored as capital for 12 months from when you receive them, after which anything left counts as savings.

Does ADP affect Pension Credit or Council Tax Reduction?

It does not reduce either. GOV.UK lists ADP among the benefits not counted as income for Pension Credit. For Council Tax Reduction in Scotland, ADP is not unearned income and it can qualify you for the disability premium, which may increase your reduction.
