A re-determination is the first step to challenge an Adult Disability Payment determination. Social Security Scotland looks at your case again before you can appeal to a tribunal. You must ask within 42 days of your determination letter, and Social Security Scotland must decide within 56 days. If they miss that deadline, you get a direct right of appeal.
You need a re-determination before you can appeal. Even if the re-determination fails, the outcome it produces is what unlocks the right to appeal at the First-tier Tribunal for Scotland (Social Security Chamber). So a re-determination is never wasted: it is either a faster win or the gateway to the tribunal route.

A re-determination letter is your formal written challenge to an Adult Disability Payment determination. In Scotland, most determinations are made on paper, so your written case is decisive. The strongest re-determinations share six features:
42 days from the date on the determination letter. If you are sending late, Social Security Scotland can accept the request up to a year later if you show good reason (hospital admission, illness, did not receive the letter, etc.). Social Security Scotland must then complete the re-determination within 56 days. If they miss that deadline, you get a direct right of appeal to the First-tier Tribunal. You can also request a re-determination by phone on 0800 182 2222 or online through mygov.scot. Whichever route you use, keep proof of posting or a note of the date and time you called.
If an existing award was reduced or stopped at review and you challenge it, you can ask for Short-term Assistance. This pays the difference between your old and new award while your case is decided, and it continues through the re-determination and any appeal. You do not have to pay it back even if you lose. Short-term Assistance is only available where an existing award is reduced or stopped, not for a refused new claim.
